Terms of service

These terms govern the contract between KLEOS Bilişim Danışmanlık Ltd. Şti. ("DXMAP.ai", "we") and the customer ("you").

The service is directed exclusively at businesses, public bodies and professionals acting in the exercise of their trade. It is not offered to consumers. Conflicting or supplementary terms of the customer do not apply unless we agree to them in writing.

DXMAP.ai provides a diagnostic assessment and the report that comes out of it:

• Digital Maturity Assessment: the 70-question assessment and the whole seven-section Digital Maturity Report, including its sources, the complete risk analysis and the implementation model. Purchased directly through the website.

Its scope is described on the pricing page. There is no subscription, no further package and no recurring engagement.

The contract is concluded when you complete the checkout and the payment is confirmed. You receive an order confirmation by email.

Where payment is made by bank transfer, the contract is concluded when we confirm receipt of the payment and the assessment is opened in your account.

Prices are stated exclusive of VAT unless indicated otherwise. VAT is added where applicable; for business customers in the EU with a valid VAT ID, the reverse charge applies.

How payment is taken follows the country your company is in: by card in euro, processed by Stripe, or by bank transfer in Turkish lira for customers in Türkiye. Card payment is due immediately at checkout. Where payment is by bank transfer, the invoice is payable within 14 days of invoice date and the assessment is opened once we confirm receipt.

Figures shown on the website while marked indicative are not binding offers. The binding price is the one shown at checkout.

Because the service is directed at businesses and not consumers, no statutory right of withdrawal applies.

As a matter of practice: if you have purchased the assessment and have not started it, contact us and we will refund it. Once the report has been generated from your answers it cannot be returned, since it is produced individually for you.

The quality of the report depends on the quality of the answers. You undertake to provide accurate information to the best of your knowledge and to route questions to people who can answer them.

You are responsible for keeping account credentials confidential and for the acts of users you invite into your organisation workspace.

You may invite only people who belong to or work for your organisation and with whom you are authorised to share your organisation's assessment. By sending an invitation you confirm this, and that you have told the person they are being invited. Invited users must accept these terms as authorised users of your organisation before using the service. You hold us harmless from claims arising from invitations sent without authority.

You receive a non-exclusive, non-transferable right to use the report within your own organisation, including with your advisors, for an unlimited period.

The methodology, question sets, models, benchmarks and templates behind the report remain our intellectual property. Publishing the report externally, or reselling it, requires our written consent.

We may use anonymised, aggregated data derived from assessments to improve benchmarks, provided no single organisation can be identified.

The report narrative and the chat assistant's replies are generated by language models from your answers. They can contain errors or omissions. The report is decision support: you review it before acting on it. It is not legal, tax or investment advice.

The questions are about your organisation. Do not enter personal data about named individuals, special categories of personal data or third parties' confidential information into the assessment. You are responsible for the content you enter.

We aim for high availability but do not warrant uninterrupted access. Maintenance is scheduled outside business hours where possible.

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under mandatory statutory provisions.

For slight negligence we are liable only for breach of a material contractual obligation, and limited to the foreseeable damage typical for this type of contract. Liability is capped at the fees paid for the engagement concerned.

The report is a decision-support document. It does not constitute legal, tax or investment advice, and the figures in it are estimates based on your own answers.

Each party keeps the other's confidential information confidential and uses it only for the purpose of the engagement. This survives the end of the contract.

We do not name you as a customer publicly without your written consent.

The assessment is a one-time engagement that ends when the report is provided. There is no recurring term, so no notice of termination is required. The right to terminate for cause remains unaffected.

Processing of personal data is described in the privacy policy. For accounts, billing, the website and benchmarking we are the controller, as described in the privacy policy; for assessment content we act as your processor under the data processing addendum, which forms part of this contract.

The UN Convention on Contracts for the International Sale of Goods does not apply.

We may amend these terms for future contracts. The version in force at the time of your order applies to that order.
